By downloading, accessing, or using the Health-TRKD mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, do not use the App. We may modify these Terms at any time, and such modifications will be effective immediately upon posting the modified Terms within the App or on our website. Your continued use of the App signifies your acceptance of the modified Terms.
Health-TRKD is designed to provide health, fitness, and nutritional information for educational and suggestive purposes only. The content, including but not limited to text, graphics, images, reminders, tasks, and other material contained within the App ("Content"), is not intended to be, and should not be considered as, a substitute for professional medical advice, diagnosis, or treatment.
Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition, diet, fitness regimen, or any other health-related matter. Never disregard professional medical advice or delay in seeking it because of something you have read, seen, or a suggestion you have received from this App.
Reliance on any information provided by Health-TRKD, its employees, or others appearing on the App at the invitation of Health-TRKD, or other users of the App is solely at your own risk. The App may contain health- or medical-related materials that are general in nature. If you find these materials offensive, you may not want to use our App.
If you think you may have a medical emergency, call your doctor or emergency services immediately.
Health-TRKD grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. You agree not to use the App for any other purpose, including any commercial purpose, without our express prior written consent.
You agree to use the App in compliance with all applicable local, state, national, and international laws, rules, and regulations.
You are responsible for ensuring that your use of the App, including the performance of any suggested tasks, exercises, or dietary changes, is appropriate and safe for your individual health condition and capabilities. Always consider your personal health status and consult with a healthcare professional before starting any new diet or exercise program or making significant changes to your existing routines.
To use certain features of the App, you may be required to create an account (e.g., via Google Sign-In). You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
If the App allows you to create, upload, or share content (e.g., custom tasks, notes, progress logs) ("User Content"), you retain ownership of your User Content. However, by submitting User Content, you grant Health-TRKD a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the App and Health-TRKD's (and its successors' and affiliates') business, including for promoting and redistributing part or all of the App (and derivative works thereof) in any media formats and through any media channels.
You are solely responsible for your User Content and the consequences of posting or publishing it. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish User Content you submit.
The App and its original Content (excluding User Content), features, and functionality are and will remain the exclusive property of Health-TRKD and its licensors. The App is protected by copyright, trademark, and other laws of both [Your Country/Region] and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Health-TRKD.
Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into these Terms. THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. HEALTH-TRKD DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
IN NO EVENT SHALL HEALTH-TRKD, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (III) ANY CONTENT OBTAINED FROM THE APP; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) TO USE THE APP.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App or request account deletion if such a feature is available.
These Terms shall be governed and construed in accordance with the laws of [Your Country/State/Jurisdiction, e.g., "the State of California, United States"], without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
